Terms of Service

These Terms are an agreement between you and Jinko LLC, d/b/a bookmark.land ("bookmark.land", "we", "us"), 212 Copper Square Drive, Bethel, CT 06801, United States. They cover your use of the bookmark.land website, web app, REST API and browser extension (together, the "Service").

The following also apply, and form part of these Terms:

  • our Privacy Policy and Cookie Policy, which explain how we handle personal information;
  • the Browser Extension License, if you install the extension.

When you create an account, you're asked to agree to these Terms and the Privacy Policy. If you don't agree, please don't use the Service.

Nothing in these Terms takes away rights you have under consumer protection laws that can't be waived where you live.

1. Your account

  • You must be at least 16 years old, and old enough to form a binding contract where you live.
  • An account is for one person. Plans are for individual use. We don't currently offer team or business plans.
  • Give us accurate information and keep it up to date. You can sign in with email or with Google.
  • Keep your sign-in details and API tokens secure. You're responsible for activity on your account. Tell us at [email protected] if you think someone else has access.

2. The Service

bookmark.land lets you save, organise, search and share links. We keep improving it, which means features can change. If we remove a significant feature from a paid plan during your billing period, we will tell you in advance. If the change materially reduces what you paid for, you can cancel and get a pro-rated refund for the unused time.

Features marked beta or preview may change or stop working, and are provided as they are.

We aim to keep the Service available and your data safe, but we don't guarantee uninterrupted service. Please keep your own copy of anything important: you can export your library at any time from the Import & Export page.

3. Your content

"Your content" means the links, titles, notes, tags, collections, highlights, files and anything else you add to the Service.

  • You own your content. We claim no ownership of it.

  • What you let us do with it: you give us a worldwide, non-exclusive, royalty-free licence to host, store, copy, process and display your content only to run the Service for you. That includes:

    • fetching information and screenshots of the pages you save, and checking whether links still work;
    • making backups;
    • showing it to others when you choose to make a collection public.

    This licence ends when you delete the content or your account, except for copies in routine backups until they expire.

  • Public collections: anyone with the link can see a collection you make public, including its bookmarks, titles, descriptions and notes, until you make it private.

  • Your responsibility: you're responsible for your content and for having the right to add it. Don't add content that breaks the law or these Terms.

  • Feedback: if you send us ideas or suggestions, we may use them freely, with no obligation to you.

4. Acceptable use

Don't use the Service to:

  • break the law, or infringe anyone's intellectual property, privacy or other rights;
  • publish, through public collections or otherwise, content that is illegal, sexually exploits minors, harasses or threatens people, or promotes violence;
  • distribute malware, phishing links or spam;
  • try to get unauthorised access to the Service, other accounts or our systems; probe, scan or test their vulnerabilities without our written permission; or interfere with their operation (for example, overloading them or attacking them with denial-of-service);
  • get around plan limits, rate limits or security measures;
  • access the Service by automated means other than the official API and browser extension, or scrape other people's public collections in bulk;
  • copy, sell, resell or offer the Service to others as a service; or reverse engineer it, except where the law allows you to.

We may remove public content that breaks these rules, and suspend accounts as described in section 8.

5. API and browser extension

  • You can use the REST API with API tokens you create in Settings, within the documented rate limits and the limits of your plan. Treat tokens like passwords. We may revoke tokens that are misused or that put the Service at risk.
  • You may build tools for your own use, or open-source tools that other users run with their own tokens. Don't use the API to collect other users' data.
  • The browser extension is licensed under the Browser Extension License. What it can access is explained on the Browser Extension Privacy page.

6. Plans and billing

Plans:

  • Explorer is free, with up to 100 bookmarks.
  • Pro ("Infinite Library") is a paid subscription, billed monthly or yearly at the price shown at checkout.

Payments through Polar: Polar processes payments, subscriptions and sales tax for us as merchant of record. When you buy, you also agree to Polar's terms for the payment. Prices are in US dollars. Any applicable sales tax or VAT is calculated and shown by Polar at checkout.

Automatic renewal: your subscription renews automatically at the end of each billing period (each month or each year) and is charged to your payment method, until you cancel. For yearly plans, we will email you a reminder at least 15 days before each renewal.

Cancelling:

  • Cancel any time from Manage Billing in Settings. Cancelling stops future charges.
  • You keep Pro until the end of the period you've paid for, then your account moves to Explorer.
  • Your bookmarks are kept. If you have more than Explorer allows, you can still view, organise, export and delete them, but you can't add new ones until you're under the limit or upgrade again.

Refunds:

  • 14-day money-back guarantee. If you ask within 14 days of your first Pro payment, or of a yearly renewal payment, we'll refund that payment in full. Email [email protected] from your account email address. This guarantee also covers any statutory right of withdrawal you may have, for example in the EU or UK.
  • Otherwise, payments for the current period are not refundable, and we don't refund partial months or years. The exceptions:
    • where the law requires a refund;
    • where these Terms give you a pro-rated refund (sections 2, 8 and 11).
  • Refunds go back to the original payment method through Polar.

Price changes: we'll tell you at least 30 days before a price change applies to you. It takes effect at your next renewal, so you can cancel before then.

Failed payments: if a payment fails, Polar may retry it. If it can't be collected, your account moves to Explorer, under the same rules as cancelling.

Education offer: if we confirm you're eligible through a valid .edu email address, you get Pro free for the period stated in the offer (currently 4 years), with no payment details needed. When the period ends, your account moves to Explorer and you're never charged automatically. We may end the offer early for someone who isn't eligible or who abuses it.

Promotions and gifts: promotional or gifted Pro time lasts for the period stated. It doesn't renew automatically, and it can't be exchanged for cash.

7. Copyright complaints

If you believe content in a public collection infringes your copyright, email [email protected] with:

  • your contact details;
  • the work you believe is infringed;
  • the link to the content;
  • a statement that you believe in good faith the use isn't authorised;
  • a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorised to act for them;
  • your physical or electronic signature.

We will remove or disable access to infringing content, and may close the accounts of repeat infringers. If your content was removed and you believe that was a mistake, you can send us a counter-notice at the same address.

8. Suspension and termination

You can stop using the Service at any time. Delete account in Settings deletes your account and library from our live systems (backup copies expire on our providers' schedule, and privacy records are kept as our Privacy Policy explains), so export your library first (Import & Export) if you want a copy. Deleting your account cancels any active subscription immediately, with no further charges. If you paid in the last 14 days and want the money-back guarantee (section 6), ask for your refund before you delete.

We may suspend or close your account if you seriously or repeatedly break these Terms, if the law requires it, or to protect users or the Service. Where reasonable, we will warn you first and give you a chance to fix the problem and to export your data.

If we close your account or discontinue the Service without you having broken these Terms, we will give you at least 30 days' notice where we can, and a pro-rated refund of any prepaid, unused subscription time.

Sections 3 (feedback), 9, 10, 11 and 13 continue to apply after your account ends.

9. Disclaimers

We provide the Service with reasonable care and skill. Apart from that, and to the extent the law allows, the Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We're not responsible for the content of websites you bookmark, or for information we fetch from them (such as titles, previews and link-check results), which may be wrong or out of date.

10. Limitation of liability

To the extent the law allows:

  • we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data;
  • our total liability for all claims relating to the Service or these Terms is limited to the greater of the amount you paid us in the 12 months before the claim arose, or US$50.

These limits don't apply to liability that can't be limited by law. That includes liability for fraud, for gross negligence or wilful misconduct, and, where applicable law says so, for death or personal injury caused by our negligence. If you're a consumer in the EU or UK, we're responsible for loss or damage you suffer that is a foreseeable result of our breaking these Terms or failing to use reasonable care and skill.

11. Changes to these Terms

We may update these Terms from time to time.

  • Material changes: we will give you at least 30 days' notice by email or in the app, and ask you to accept the new Terms where required.
  • Minor changes (for example clarifications, or changes required by law) can take effect when we post them.

If you don't agree with a change, you can cancel before it takes effect. If you're on a prepaid yearly plan, you'll get a pro-rated refund for the unused time. The version and effective date are shown at the top of this page.

12. Indemnity

If you use the Service for business purposes, you agree to cover our reasonable costs (including legal fees) arising from third-party claims caused by your content or your breach of these Terms. This section doesn't apply to consumers, except where the law allows it.

13. Governing law and disputes

Please contact us first at [email protected]; most problems can be solved quickly. If we can't resolve a dispute within 30 days:

  • These Terms are governed by the laws of the State of Connecticut and applicable U.S. federal law, without regard to conflict-of-laws rules.
  • Disputes will be decided by the state or federal courts located in Connecticut, and you and we consent to their jurisdiction. Either of us may instead bring an individual claim in small-claims court.
  • If you're a consumer outside the United States, you also keep the protection of the mandatory consumer laws of your country of residence, and you may bring proceedings in the courts there.

14. General

  • These Terms, together with the documents listed at the top, are the entire agreement between you and us about the Service.
  • If any part is found unenforceable, the rest stays in effect.
  • We may transfer these Terms to a successor in a merger, acquisition or sale of the Service, and we'll tell you if that happens. You may not transfer your account.
  • If we don't enforce a right right away, that doesn't mean we waive it.
  • Neither of us is responsible for delays caused by events beyond reasonable control.
  • Notices: we send notices to your account email address or show them in the app. You can send notices to [email protected] or to our postal address.
